End User Licence Agreement

This End User Licence Agreement (“EULA”) is an agreement between you and Nations Network Africa (“NNA TV Plus”, “we”, “us”) governing your use of our applications:

• NNA TV+ for Android and iOS; and
• Ultra Stream for Android TV and compatible TV devices.

(each, the “Application”). By downloading, installing or using an Application you agree to this EULA, our Terms of Service and our Privacy Policy.

1. Licence Granted

We grant you a limited, personal, non-exclusive, non-transferable, non-sublicensable and revocable licence to install and use the Application on devices you own or control, solely for your own private, non-commercial use of the NNA TV Plus service.

2. What You May Not Do

You may not:

• copy, modify, adapt, translate or create derivative works of the Application;
• reverse engineer, decompile or disassemble the Application, or attempt to derive its source code, except to the extent this restriction cannot lawfully be imposed;
• rent, lease, lend, sell, sublicense, distribute or otherwise transfer the Application;
• remove or alter any copyright, trade mark or other proprietary notice;
• circumvent, disable or tamper with any security, authentication, subscription check or access-control mechanism in the Application or our servers;
• use the Application to capture, record, download or redistribute streamed content; or
• use the Application in any unlawful way or in breach of our Terms of Service.

3. Ownership

The Application is licensed, not sold. We and our licensors retain all right, title and interest in and to the Application, including all intellectual property rights. You receive only the rights expressly granted in this EULA.

4. Subscription and Content Access

The Application is a means of accessing the NNA TV Plus service. Viewing subscriber content requires an active subscription. Subscriptions are purchased and billed through our website and are governed by our Terms of Service and Refund & Cancellation Policy. Certain content, such as trailers and free programming, may be available without a subscription.

5. Updates

We may release updates, patches and new versions of the Application. The Ultra Stream TV application checks our servers for updates and may download and install them so that the Application remains secure, compatible and functional. This EULA applies to all updates unless a separate agreement accompanies them. We may discontinue support for older versions, operating systems or devices.

6. Device, Network and Data

You are responsible for your device, your internet connection and any data charges. Video streaming uses a significant amount of data. Performance depends on your connection speed, device capability and network conditions, which are outside our control.

7. Permissions and Information Collected

The Application may request permissions such as network access, storage and notifications. It may collect technical information — including device model, operating system and app version, crash reports and playback diagnostics — to keep the service working and to fix faults. 8. Third-Party Terms

The Application may include third-party software components licensed under their own terms, which continue to apply to those components.

Where you obtained the Application from an app store, you acknowledge that:

• this EULA is between you and us, not with Apple, Google or any other store operator;
• the store operator has no obligation to provide maintenance or support for the Application;
• the store operator is not responsible for addressing any claims relating to the Application, including product liability, legal compliance or intellectual property claims; and
• the store operator and its subsidiaries are third-party beneficiaries of this EULA and may enforce it against you.

9. Termination

This EULA applies until terminated. It ends automatically if you breach any of its terms. We may also suspend or terminate your licence if you misuse the Application or breach our Terms of Service. On termination you must stop using the Application and remove it from your devices. You may end this EULA at any time by uninstalling the Application.

10. Disclaimer of Warranties

Except for warranties that cannot be excluded by law, the Application is provided “as is” and “as available”, without warranty of any kind. We do not warrant that the Application will be uninterrupted, error-free, or compatible with every device or network.

11. Limitation of Liability

To the maximum extent permitted by law, we will not be liable for any indirect, incidental, special or consequential damages arising from your use of or inability to use the Application. Our total aggregate liability relating to the Application is limited to the subscription fees you paid to us in the 12 months before the claim arose. Nothing here excludes liability that cannot lawfully be excluded.

12. Governing Law

This EULA is governed by the laws of the Republic of South Africa, and you agree to the non-exclusive jurisdiction of the South African courts. Nothing in this EULA limits your rights under the Consumer Protection Act, 2008 or other laws that cannot be excluded by agreement.
